ClandesTime 111 – The Manchester Bombing and the Politics of Fear

The bombing in Manchester this week was an especially horrific act of terrorism. 22 people were killed and dozens more were injured – many of whom were children or teenagers who were exiting an Ariana Grande concert. This week I examine some of the questions I have about this bombing, and outline a lot of relevant context that has so far been ignored by virtually all media coverage of the event. I explain why the default alternative view of terrorist attacks in the West – that they are in some way ‘blowback’ resulting from NATO foreign policy – is at best a misleading simplification.  I round off by criticising Jeremy Corbyn’s latest speech for appearing to offer an alternative to the War on Terror while repeating the same prejudices and assumptions that underpin it.

Orjafirmat

Kansainvälisten ihmisoikeusjärjestöjen määritelmän mukaan orjuus on mm. työtä josta ei voi kieltäytyä tai työtä josta ei saa riittävää toimeentuloa. Suomessa nykyajan orjuus on nykyisen ja aikaisempien hallitusten toimesta laillistettu palkattoman työharjoittelun muotoon.

Kenen mielestä on olemassa työtä josta ei tarvitse maksaa palkkaa?

Palkattomaan työhön ei ole olemassa mitään perustetta. Palkan suuruuden kuuluu toki vaihdella osaamisen, kokemuksen ja työtehtävien mukaan, mutta palkaton työ jonka arvo työnantajalle on enemmän kuin 0 eur / kk, on kaiken mittapuun mukaan perustuslaissa ja kansainvälisessä oikeudessa kiellettyä orjuutta.

ClandesTime 100 – Sex, Violence and Censorship

Why do we censor films?  Intuitively we all know the answer to this question – because there are some things we don’t want to see on the screen.  In this episode we examine film censorship, focusing primarily on the treatment of cinematic violence by the MPAA and BBFC.  Using Walter Benjamin’s Critique of Violence as a foundation I discuss how societies are attempts to rationalise violence and determine what are legitimate and illegitimate uses of force.  We then look at how censorship does not do much to limit the scale or type of violence shown on screen, but instead prevents the depiction of the consequences of violence, the suffering and pain, before talking about how this kind of censorship influences our views of real-world violence, especially that committed by the state.

Hedman Partners kiristyskirjeet - Markkinaoikeuden päätös - IP osoite ei riitä tuomioon

Hedman Partners on hävinnyt markkinaoikeudessa kanteen jossa korvauksia vaadittiin laittomasta elokuvan ja tv-sarjojen lataamisesta. Hedman Partnersei pystynyt osoittamaan oikeudelle että internetliittymän ja IP-osoitteen haltija oli juuri se henkilö joka tekijänoikeuden alaista materiaalia oli jakanut liittymänsä kautta. Tekijänoikeuden haltijat Scanbox Entertainment A/S ja Crystalis Entertainment UG velvoitettiin korvaamaan vastaajan oikeudenkäyntikulut 28 000 euroa korkoineen.

Markkinaoikeuden päätös.

Meillä on nyt kaksi markkinaoikeuden päätöstä jotka osoittavat tekijänoikeusjärjestöjä edustavien tahojen vaatimukset ja perusteet kohtuuttomiksi. Korvausvaatimukset ovat täysin ylimitoitettuja. Vuonna 2016 annetussa päätöksessä esimerkiksi tv-sarjojen laittoman jakamisen kohtuulliseksi korvaukseksi määrättiin vain kymmeniä euroja. Nyt tammikuussa 2017 annetussa päätöksessä markkinaoikeus on selkeästi ja oikeusvaltion periaatteiden mukaisesti nähnyt ettei pelkkä IP-osoitteen omistaminen tee henkilöä syylliseksi, kantajan on osoitettava syyllisyys muulla todistelulla.

WLAN verkon suojaamattomuus nousee kynnyskysymykseksi. Onko verkkoa voinut käyttää myös joku muu kuin vastaaja. Käytännössä kantajan on osoitettava verkon olleen suojattu ja vastaajan verkon olleen avoin. Markkinaoikeuden päätöksen perusteluista voi tulkita, että erityisen tärkeä peruste on ollut vastaajan henkilötodistaja verkon avoimuudesta. Pelkkä tekninen todistelu tukiaseman tilasta, sen kuuluvuudesta, kantajan tekemistä mittauksista tai tukiasemaan kirjautuneista laitteista ei näytä riittävän.

Siksi jatkossa onkin syytä muistaa muutama asia. Kiristyskirjeen lähettäjälle ei tule kertoa mitään tietoja omistamistaan tukiasemista tai verkkojen SSID nimistä. Kantaja on kummassakin tapauksessa käynyt mittaamassa paikan päällä mitä verkkoja, suljettuja tai avoimia vastaajan kotiosoitteen läheisyydessä kuuluu.  Lisäksi vastaajan on hyvä varmistaa että WLAN verkon avoimuudelle löytyy henkilötodistaja.

In this episode and the next, we’re going to look at two instances in the early Cold War of American-sponsored and -instigated overthrows of democratically elected governments, and their replacement by unpopular, USA-backed dictatorships.  Of course, I’m talking about Iran and Guatemala in the early-1950s.  This episode will set the context and cover Iran.  Next time we’ll cover Guatemala and consequences of these sorts of operations.

Encouraged by their success against Iran’s democratic government (covered in last episode), the Dulles Brothers’ next move was against the small central American country of Guatemala, where a left-of-center government appeared to be threatening the interests of the United Fruit Company.

This is the little-known story of how Florida became a part of Team America.  (Spoiler:  It wasn’t totally voluntary…)

  • The background to the war:  what was going on in Florida leading up to the war, & who the Seminoles were, including the so-called ‘Black Seminoles’
  • Why the United States coveted Florida almost from day one of getting its independence
  • The destruction of the so-called “Negro Fort” by American forces in 1816
  • The immediate issues that led to fighting beginning in late 1817, culminating in Andrew Jackson’s invasion of West Florida in 1818
  • How Jackson exceeded his orders (which just allowed him to retaliate against hostile Indians), and went so far as to seize Spanish installations and execute two Brits who were found in the area
  • Secretary of State John Quincy Adams’ successful negotiation of a treaty in 1819 formally transferring Florida (East and West) to the US without provoking war or major retaliations from either Spain or Britain

Ep. 0024: The Second Seminole War

Last time, we covered the First Seminole War; this time, we get to the nastier sequel.
The Second Seminole war was the US government’s longest and most expensive Indian War.  It also had many parallels to later campaigns in harsh environments against determined guerrilla fighters, and many lessons which, unfortunately, were not learned, as the nation did its best to consign the conflict to the ‘memory hole’ soon after its end.  Long before the Philippines War, and even longer before Vietnam, there was this brutal war…

  • The 1823 Treaty of Moultrie Creek, which tried to confine the Seminoles to a reservation in central Florida, requiring most of them to relocate, cutting off their access to the coasts, denying their freedom of movement, and requiring them to assist in the capture and return of escaped slaves
  • The election of Andrew Jackson as president in 1828, which would have disastrous consequences for Southeastern Indians, including the Seminole
  • The Indian Removal Act and subsequent attempts to bribe or dupe the Seminoles into relocating out West
  • The rise of Osceola
  • The beginning of violence in 1835 with the so-called ‘Dade Massacre’ and assassination of the US Indian Agent Wiley Thompson
  • How US General Thomas Jesup captured Osceola by betraying a flag of truce, something even most white Americans found dishonorable
  • Osceola’s captivity and death from illness within a few months
  • The brutal Battle of Lake Okeechobee on Christmas Day, 1837
  • Continued Seminole guerrilla operations and American countermeasures, which sought to grind them down
  • The cessation of fighting in 1842, by which time the Seminole population of Florida had been reduced by approximately 94% in 20 years due to death and deportation
  • A brief mention of the much smaller Third Seminole War (1855-58)
